I’m really sorry to read about your dilemma. Since I'm an independent maid agent myself what I can say that such case exists. Recently I was informed by my Indonesian agent that a few clinic or medical center in Indonesia whose licenses are being revoked by M'sia govt due to medical rpt being forged by irresponsible party.
My advice to you is to openly discuss with your previous agent though he no longer in the business. Perhaps you could ask for him to compensate half of the fee or something. It is rather natural if he (or for that matter any agent) would say the disease could possibly be contracted during her service with you.
As for the refund, even if one hires a maid from a registered agency, they would not refund the money if it is later discovered that the maid is infected with disease unless you do the medical checkup during the warranty period. You have the right to demand a replacement if the warranty is still valid.
One of the reason why registered agency's maid fee is expensive i.e. RM4000 and above is because they do another round of medical checkup upon entering this country.
I normally recommend my client to perform a second round of medical checkup if he/she wants to be doubly sure that the maid is medically fit. And it doesn't have to be at a FOMEMA registered clinic. In the case of my agent he would replace if the result is otherwise provided the medical checkup is performed during the warranty period.
